土地の瑕疵 家の瑕疵(住宅瑕疵担保責任保険） [住宅]
現在、法律で、瑕疵担保責任保険が登場し、家を買う人には、10年間の躯体保証が付くこととなりました。工務店の10年保証と別なんですが、とにもかくにも、買う側には悪い話ではありません。
しかし、これは、住宅品質保証だったのが変わったと言うことなので、任意が義務となり、施工する側は新しい仕組みに手間取っています。
10年の延長保険に関してもまだ出ていませんし、また、他の商品も出揃っていないのが現状で、住宅保証機構に聞いても、まだわからないの一点張り・・・・
さて、それと関連していますが、土地の瑕疵の話ですが、土地の瑕疵というと、地盤が悪いということではなく、埋設物の事です。
売主が買主に引き渡す土地に 例えば、受水槽だとか浄化槽があった場合、これは、全く買主側にはわからないことで、売主側に責任があると見られます。
よく、基礎工事するときに出てきたりして、工事が遅れたりしますが、そうなった場合、それは、施主の責任として、工期が遅れることを承認してもらうときが多々あります。
しかし、地盤が単純に悪いだけでは、瑕疵にはならない場合が多く、購入前に調べておくか、または、購入条件にしておき、売主に地盤調査をしてもらうかしておかないと、あとあと、突然、費用が別にかかったりする場合があります。
費用については、場合によって違うですが、
表層改良という地盤がそんなに悪いわけではないが、やった方が良いという場合の改良だと、建坪20坪程度で、60～70万。
また、ｺﾝｸﾘｰﾄﾐﾙｸを入れて改良する柱状改良の場合は、100万～130万となり、他にもありますが、ざっと一般的なものはこんな感じです。
自分の場合、ジオという会社のホームページにある市別の地盤データを参考にしています。
基本的に、家が建っていた場所の上に建つ以外は必ず、地盤調査を行う必要があります。
地盤調査代は、スウェーデン式サウンディングで5～7万です。
家の総工事費に比べるとそんなに高くない費用なので、しっかり調べて、設計にまわしたほうが、予算もずれがありません。
これから、家のプランをする方は、必ず、地盤調査してくださいね。
その際、住宅品質保証の免許で地盤調査できるか、要するに、その地盤データを瑕疵担保責任保険で使いますので、その事も聞いて方が良いかと思います。

今後、建て替え時に地中に埋まったコンクリート埋蔵物が、社会問題化するのではないか？との危惧を持っています。
木杭や引き抜きの出来る鋼製杭などの至要だ進むと良いと思っていますが、コスト優先の昨今では難しいですね。
