瑕疵担保保険の盲点

 

↑押してして頂けると大変恐縮です。(というか本当に助かります。上だけでもお願いします。）

瑕疵担保保険が10月から正式に始まります。

というか、１０月引渡しからなので、現在、実質、施工しているものは全て含みます。

しかし、関わっていて、問題点を発見。

そもそもこの保険は、建設業者や宅建業者を救済するという名目。

ですから、施主が自分で、そう、請負契約しないで、施主の名前で職人さんに発注するのなら、いらないのでは？と言えるのですが・・・・・・・

実は、細かい工事、即ち、部分的に、例えば、基礎工事をする業者が「建設業の免許」を持っている場合、やはり瑕疵保険は必要となるそうです。

そういえば、今時、建設業の免許がない業者なんているのかしら？と思ってしまいますが、そうなると、施主施工でもいることになりますね。

CM方式といって設計事務所が音頭をとる場合は、設計事務所が保険をかけたりしますが、この場合、複数業者がいた場合、どこかの業者が代表で保険をかけなくてはいけないそうです。

職人さんたちは、この保険についてよく知りません。というか、このようなイレギュラーの場合、自分たちでも知らないのです。困ったものです。

昨今、この保険のせいで、地盤調査必須となり、必要もなさそうなところでも、地盤調査しなくてはいけません。

地盤調査会社の考え方、力量もありますが、保険をかける心配から、以前は地盤改良しないような土地でも改良しなくてはいけないと言ってくるところもあり、「地盤改良屋が儲けている」ように感じます。そして、そう感じる設計事務所さんもいるかと思います。

考え方としては、業者側としては、安全策を講じたと言うことになりますが、施主側から言わせれば、「隣は去年家を建てたが、改良なんてしていなかったぞ！　なんでうちはやるんだ。納得がいかん！」です。

地盤改良というのは、調査でだいたい　3万～5万（測点ポイント数による）、改良工事は、ものによってですが、一番ハードな、コンクリート柱状改良で、20坪程度、深さ5ｍ～6ｍとかで、100万～120万、同じ面積の軽い改良（表層改良）で、60万～80万といったところです。

設計者としても判断に苦しむ地盤もございますが、判断に苦しむと安全側で見ます。しょうがないですが・・・・・・・

ともあれ、施主施工の場合、非常に瑕疵担保保険をかける必要性の説明をするのが難しく、業者保護とうたいながらも、なんだかんだで施主に費用負担がいくので、このような、施主施工と言う場合にも対応できるよう整備してほしいものです。

瑕疵担保保険は、そもそも、この間の耐震偽装で免許取り消しとなったような、建設業者・宅建業者が対象につくられたもので、向いている方向が違うのです。

政権交代で、この法律までいじられるかわかりませんが、分かりやすい表現にしてほしいですね。

 

まー、法律を作る議員を送り出している自分たちにも責任があり、お役所・国への文句ばかりとは行きませんが・・・・・・

法律をつくった議員さんを選んだ国民の責任はもちろんありますが、瑕疵担保保険は中小工務店の請負施工の場合が一番厳しくなっていると思います。大手ハウスメーカーは一定の規格で安い保険になっていると聞きます。誠実に昔ながらの建て方を守っているところでは困った法律でしかありません。
