住宅瑕疵担保責任保険の話　[住宅] [編集]

というか、上のリンク先、意外と面白いです。ですが、押して頂けるだけでも本当に助かります。

この６月から住宅瑕疵担保責任保険が始まりました。

これはいわゆる　住宅性能保証制度に代わって出てきたもので、申請機関ＨＰでは、住宅性能保証制度は終わって、住宅瑕疵担保責任保険となりましたと書かれています。

この住宅性能保証制度が保険に代わったのですが、前の方が申請項目が多く、今回の方がまだ分かりやすいように感じます。

そもそも、保険と最初からうたっていれば、もう少し広まったように感じます。

申請する側からすれば、大変手間のかかる面倒な申請だったのですから・・・・・・・・

この申請はどちらかといえば、施工者側に申請する義務があり、施主が自主的にやるという考え方から、施工者の瑕疵の責任への保険に代わっています。

そういう意味で分かりやすいかなと思っています。

これ以外に、施工者が10年保証でメンテナンスをすることがありますが、これは保険とは別で、しかも、保険も使わないで、施工者が自費でメンテできれば、保険を使う必要がないという、いわゆる従来の保証というものです。しかし、電気製品例えば、食洗機や換気扇のような電気機器は、施工者ではなく、その機械のメーカーの保証期間のみの保証となります。

工務店のメンテナンスは、施主からクレームないし、補修依頼がくると、それぞれ担当した職人・業者が来て、チェック・補修する事で、ハウスメーカーだと、専門部署がこの業務にあたったり、または、工務店同様に職人・機器メーカー・業者にお願いしたりと言う具合です。

とはいえ、なんだかまだ複雑に感じます。そう思うのは、他の方も、一般・施工者・設計者とはず、同様に感じていると思います。

建築士法や建築基準法が一般の方への安心確保という観点から、代わっているにもかかわらず、理解浸透がなされていない中、このような法律もこれでは、少し心配ですね・・・・・・・・・

　国も結果として何が起こるかよく解らずにやっていると言うことが、昨年の建築基準法改正時に露呈したと感じました。
　改正内容の良し悪しは別としても、タスポの導入でタバコの商流の多くがコンビニ経由へと変わり、真面目にやっていらっしゃるたばこ屋の多くが廃業に追い込まれたのと同じ現象が建築業界でも進行していくような気がしています。
